Apple vs Samsung Trial : Judge orders new trial, cuts nearly $450 million

Apple had won a lawsuit last year against Samsung on patent case, where Samsung was ordered to pay Apple over $1 billion in damages. Now the judge ordered a new trial on Samsung appealing to recalculate on the damages incurred to Apple and also ruled in Samsung’s favor cutting down $450 million from the original $1 billion to be paid to Apple as damages incurred.

“The Court has identified an impermissible legal theory on which the jury based its award, and cannot reasonably calculate the amount of excess while effectuating the intent of the jury,” Judge Lucy Koh, of the United States District Court for the Northern District of California, said in an afternoon ruling.

“We are pleased that the court decided to strike $450,514,650 from the jury’s award,” Samsung said in an e-mailed statement. “Samsung intends to seek further review as to the remaining award.”

Apple and Samsung trial might continue for some more time and it will be interesting to see what happens further. Whether Apple manages to get back its $1 billion which was awarded during its first judgement ?
